A surety bond is a legal undertaking executed by the importer with the customs authority, committing to use the imported goods only for the specific end-purpose mentioned in the customs notification. If the goods are not used as specified or if IGCR-3 returns are not filed, the full customs duty waived plus 15% interest per annum from the date of import becomes immediately payable.
Every importer who has availed concessional duty under an IGCR customs notification must file IGCR-3 utilisation returns quarterly on the customs portal. Returns are due within 60 days from the end of each quarter — September 30 (Q1), December 31 (Q2), March 31 (Q3), and June 30 (Q4) in a financial year.
Missing IGCR-3 returns triggers demand notices from customs. You may be asked to pay the full duty on all goods imported under the IGCR concession along with interest. Regularisation is possible but involves penalty proceedings.
