What is Anti-Dumping Duty and When Does It Apply?

Anti-dumping duty (ADD) is a form of customs duty imposed on imported goods that are being sold in India at a price below their normal value in the country of export (dumping), causing material injury to the domestic Indian industry that produces the same or similar goods. ADD investigations are initiated and conducted by DGTR (Directorate General of Trade Remedies) and, upon positive determination, ADD is notified by the Ministry of Finance via a customs notification.

ADD is product-specific, country-specific, and often producer-specific — meaning the same product from different producers in the same country may attract different rates. Countervailing Duty (CVD) is the equivalent measure for subsidised imports. Importers must identify all applicable ADD and CVD notifications for their product before import, compute the correct duty rate, and pay accordingly at customs clearance. Incorrect or missed ADD payment is a serious customs violation attracting penalty and interest.

Anti-dumping duty is a customs duty imposed to offset the price difference when imported goods are sold in India below their normal value in the country of origin. It is a WTO-permitted trade defence measure to protect domestic Indian industries from unfairly priced imports that cause material injury.
ADD rates are determined through DGTR investigation and notified by the Ministry of Finance. Most notifications specify: a residual rate for all unnamed exporters, and specific rates for named producers or exporters who cooperated in the investigation. The rate applicable depends on who manufactured and exported your goods.
Changing the country of origin to a non-named country can eliminate ADD if there is substantial transformation in the third country. However, simply routing goods through a third country without genuine value addition is anti-circumvention — DGTR can initiate anti-circumvention proceedings and impose ADD retroactively.
NUF (New User Facility) allows an importer who was not a participant in the original ADD investigation to apply to DGTR for an individual assessment of the dumping margin based on their own specific supplier's cost and pricing data. If granted, the importer gets a lower producer-specific ADD rate rather than the higher residual rate.
ADD notifications are typically issued for 5 years. Before expiry, a Sunset Review is conducted by DGTR to determine whether ADD should be extended. If the review concludes dumping is likely to continue or recur, ADD is extended for another 5 years. If not, it is revoked. Mid-term reviews can modify rates during the 5-year period.
