It verifies whether the declared import value is genuine and not influenced by the relationship. SVB registration is required when an importer in India has a related party relationship with the overseas supplier. Customs Rule 2(2) defines related parties as: companies where one controls the other, companies under common control, parent and subsidiary, associated enterprises, companies with common shareholders holding 5% or more, and employers and employees.
EDD is a security deposit collected by customs on each import Bill of Entry during the SVB investigation period, typically 1-5% of the declared CIF value. It is a provisional payment pending the SVB Order. If the SVB Order accepts the declared transaction value, the EDD is fully refundable. If SVB enhances the value, the EDD is adjusted against the additional duty demand.
SVB investigations typically take 3-12 months depending on the complexity of the related-party relationship, completeness of the questionnaire, and SVB workload at the specific port. Complex MNC structures with multi-layer related party arrangements take longer.
Technically yes, but practically it is not advisable. Importing on full duty does not exempt you from SVB obligations. SVB registration must be done regardless. The EDD collected on provisional assessment is refundable if the SVB Order is favourable, making full duty payment less efficient.
If the SVB Order accepts the declared transaction value, all EDD is refunded and subsequent imports proceed on self-assessment at the declared value, subject to SVB confirmation. The Order is valid for 3 years and must be renewed. If SVB enhances the value, a differential duty demand is issued which can be challenged through the appellate mechanism.
